Terms & Conditions

All design work is carried out by Ella Whittle Design on the understanding that the client has agreed to the below terms and conditions.

Bookings & Payments

Prior to any design work starting, Ella Whittle Design requires the client to pay a 50% non-refundable deposit of the total cost of the design work. This is to secure a start date for the project. Payments are accepted by BACS for UK customers, and PayPal for international customers. Design slots are not held without a deposit. If the client decides not to proceed with the project following payment of the deposit, this will not be refunded.
 
Work is undertaken on a first come, first served basis. A project start date and an estimated timescale for completion will be provided upon enquiry. The timescale for completion may change is there are delays in communication from the client. If the 50% deposit is paid more than 24 hours after the project start date was provided, the date may have become unavailable. If this is the case, Ella Whittle Design will schedule the client in on the next available project date and the client will be informed.
 
Upon completion of design work and project sign-off, Ella Whittle Design will request the remaining 50% payment before releasing final files to the client by email. If the remaining payment has not been paid within 72 hours, the project work will be archived. If the client is to request amendments after the project has been signed off, these will be charged at 50% of the original service price.
 
If the client wishes for the project work to be released after the 72 hour period, a fee of 20% of the total project price will be requested. This fee is payable on top of the outstanding 50% payment.

If no contact is made by the client after 3 months of their project start date, any design work that has not been finalised will be automatically deleted.

Ella Whittle Design reserves the right to terminate services as any time if the client displays rude, abusive or condescending behaviour at any point throughout the project. Any design work will be deleted and the client will be blacklisted from all future services.

the design process

Upon receipt of the deposit payment and a confirmed project start date, Ella Whittle Design will make the client aware of the information needed to begin work. This information is required at least 24 hours before the agreed project start date. Failure to provide this information within this timeframe will delay the project start date.
 
The information required could be (but is not limited to): colour palette ideas, design inspiration, imagery, preferred font styles. It is strongly recommended to create a moodboard using Pinterest and providing a link to this when completing the enquiry form.
 
For pieces of design work that require a large amount of text, e.g. price lists or manuals, this is required to be sent to Ella Whittle Design in text format (Word document is preferred), the client having checked over spelling and grammar beforehand. Screenshots and pictures of text are not accepted. Ella Whittle Design cannot be held liable for any spelling, pricing or grammatical errors once final files have been approved and sent to the client (and/or the printing company if files are being sent to print by Ella Whittle Design). Any errors the client notices after accepting the designs can be rectified, but at a cost to the client.
 
If the client is booked in for a logo design, a maximum of 3 initial concepts will be created. Ella Whittle Design will make minor revisions to one of these concepts, based on feedback from the client, up to 3 times within the price paid. This ensures the client is satisfied with the final outcome. Any further changes requested will incur a £5 fee per revision thereafter. This will be added to the client’s final payment amount.

If the client is to request a design that differs from the original variations created, this is classed as a redesign rather than a revision and will be charged at 50% of the initial design price. An example of a difference could be, but is not limited to: a change in business name, or a change in overall style (e.g. from a minimal to a more complex, illustrated design).
 
The above revision process also applies to all other design work carried out.

To ensure projects are completed in good time, clients are expected to respond within 7 days of receiving initial samples. Any delays in response will impact on project delivery. Ella Whittle Design will endeavour to make a follow-up contact with the client before a late response fee is incurred. If no contact is made by the client after 7 days, a £10 'late response fee' will be added to the client's final payment amount.
 
Under no circumstance will Ella Whittle Design replicate/copy an existing piece of work, whether it be work created for a previous client or created by another graphic designer, as per the Copyright, Designs and Patents Act 1988. Inspiration will be taken from the information the client has provided, e.g. colour schemes, layouts or font styles. Designs are completely custom and will be unique to the client and their business.

The printing process

The client is solely responsible for the proofing of their designs before they are sent to print. This includes spelling, grammatical and price proofing.
 
Ella Whittle Design is not responsible for any colour variations once the clients order has been printed. Colours will always appear slightly different on-screen compared to when they have been physically printed. Please be mindful of this during the design process.
 
Ella Whittle Design is not responsible for your print parcel after it has been dispatched. Upon request, a proof of dispatch can be provided.
 
Postage and packaging fees are determined by the amount of prints purchased. A printing quote including postage fees will be sent to the client before final files are sent to print. No print order will be processed until full payment has been made.
